Salon Amavi (“we”) owns and operates various websites (“Sites”). Salon Amavi wants you to feel comfortable using the Sites, so we have created this Privacy Policy to inform you of what information we may collect from you on the Sites and how we may use that information. Please take a moment to review the terms of this Privacy Policy. By using the Sites, you agree to accept the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Sites. This Privacy Policy applies only to information collected on the Sites. It does not apply to information that we may collect by means other than on the Sites.
PLEASE NOTE: the services provided by Salon Amavi, including those provided through the Sites, are subject to the Terms of Use. Such terms may contain provisions related to your personal information and other information submitted by you through the Sites. In the event of any conflict between such terms and the terms of this Privacy Policy, the Terms of Use shall control.

In order to access the Sites, services and the information available on the Sites, you may be required to register with the Sites and provide some personal information, such as your name and email address. You may also be provided an option to choose to subscribe to an email list. If you subscribe to our electronic mailing list and later decide to opt-out, simply follow the instructions that are included in each email. If you provide us with personal information, we will retain and may use that information to contact or respond to you. We may also use personal information to customize the services we provide to you and to ensure compliance with applicable laws and regulations.
1. Aggregate Information and Passive Information Collection:
From time to time, we may collect general, non-personal, statistical information about the use of the Sites, such as how many visitors visit a specific page on the Sites, how long they stay on that page, and which hyperlinks, if any, they “click” on. We collect this information through the use of technologies such as “cookies” and “IP addresses,” which are discussed in greater detail below. Our system may also automatically collect operational information about the technology you use, such as your browser, type of computer, operating systems, internet service providers and the domain name of the Sites from which you linked to our Sites. We collect this information in order to determine which areas of the Sites are most popular and to enhance the Sites for visitors.

We may use, and to permit our service providers and analytics providers to use, cookies, flash cookies and web beacons, as well as other comparable or future technologies, to track information based on use of the Sites.
Cookies are pieces of information that a website transfers to an individual’s hard drive for record-keeping purposes. Cookies make web-surfing easier for you by saving your preferences while you’re at the Sites. The use of cookies is an industry standard — you’ll find them at most websites. By showing how and when visitors use the Sites, cookies help us see which areas are popular and which are not. Information such as the total number of visitors and pages viewed is most easily tracked with cookies. We may use the information from cookies to make improvements and updates to the Sites and to tailor our services to our visitors’ needs. Sites pages may contain electronic images known as web beacons-also referred to as single- pixel gifs-that permit Workiva to count users who have visited those pages and for other related website statistics-(e.g., recording the popularity of certain website content and verifying system and server integrity). Web beacons are not used to access your personal information on the Sites; they are solely used to compile aggregated statistics concerning the use of the Sites. Web beacons collect only a limited set of information including a cookie number, the time and date of a page view, and a description of the page on which the web beacon resides.
In addition to the foregoing, we use Google Analytics Demographics and Interest Reporting (implemented based on Display Advertising), which will track certain personal information of yours. Information collected about you is limited to age, gender and affinity categories. If you would like to opt out of the collection of such information you may do so by CLICKING HERE. Further, Google has a browser plugin (for Internet Explorer, Firefox, Chrome, Safari, Opera) that prevents your data from being collected and used by Google Analytics. At this time we do not have the ability to comply with any setting within your web browser that would send “do not track” signals or other similar technology that would provide consumers the ability to exercise choice regarding the collection of personally identifiable information.

We may use information collected via these Sites to improve the content of our Web Sites, to customize the Sites to your preferences, to communicate information to you (if you have requested it), for our marketing and research purposes, and for any other purpose specified. We may make full use of all information acquired through these Sites that is not in personally identifiable form.
Except for the limited situations discussed in this Privacy Policy, we will not share your personally identifiable information with any third parties. However, Salon Amavi may sometimes use third parties to perform certain services for us, such as hosting the Sites, sending postal mail and providing data analysis. We may provide personally identifiable information to those businesses when that information is necessary for them to respond to your requests or otherwise perform their duties.
Salon Amavi reserves the right to disclose visitor information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Salon Amavi rights or property, other visitors, or anyone else that could be harmed by such activities. Salon Amavi also reserves the right to disclose visitor information when we believe in good faith that the law requires it. However, we will have no liability for disclosure of information obtained due to errors in transmission or the unauthorized intervention of third parties.

We may group information into aggregate visitor data in order to describe the use of the Sites to our existing or potential business partners or other third parties, or in response to a government request. However, please be assured that this aggregate data will in no way personally identify you or any other visitors to the Sites.
III. Links to Other Sites
Please be aware that when you are on the Sites, you could be directed to other sites that are beyond our control. There may be links to other sites from the Site’s pages that take you outside our Sites. These other sites may send their own cookies to visitors collect data or solicit personal information. The privacy policies of these other sites may be significantly different from this Privacy Policy. We are not responsible for the privacy practices of these other sites and cannot guarantee the security of any of your personal information collected there.

Protecting the security of your personal information is very important to us. When you transmit personal information from your PC to our servers and through our service providers to access our websites, your information is protected by industry standard SSL (secure socket layer) encryption. Once we receive your transmission, we will take reasonable precautions to ensure its security on our systems. While we utilize reasonable security measures, the internet is inherently insecure. As a result, while Salon Amavi strives to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your personal information.
Users are required to sign-in to specific secured areas of Salon Amavi Sites and services using a user ID and password. These authenticate the user and are designed to safeguard against unauthorized access and use of a user’s account. The user ID and password are used on a secure web page and encrypted when transmitted over the internet.
The safety and security of your information also depends on you. If you have access to password-protected features, never share your password with anyone else, notify Salon Amavi promptly if you believe your password security has been breached, and remember to log off of this site before you leave your computer. Similarly, any personally identifiable information or personally sensitive data that you disclose through online forums hosted on the Sites, may be collected and used by others. We recommend caution when giving out personal information to others in these public online forums.

We do not knowingly collect information from children under the age of 13 on the Sites. If you are under the age of 13, please do not provide any personal information to us. If we become aware that we have collected personal information from a child under the age of 13, we will make commercially reasonable efforts to delete such information from our database.

The terms of this Privacy Policy may change from time to time. We will notify you of any material changes to this Privacy Policy by posting a notice, on the homepage of the Sites for a reasonable period of time after such changes are made, that this Privacy Policy has been updated, and by changing the “Last Modified” date at the top of this Privacy Policy. We encourage you to check this page periodically for any changes. Your continued use of the Sites following the posting of changes to these terms will mean you accept those changes.
VII. Access and Review of Data:
When using our Sites and services, we make a good faith effort to provide you with access to your personal information and either correct this data if it is inaccurate or delete inaccurate data at your request if it is not otherwise required to be retained by law or for legitimate business purposes.
Users must identify themselves and the information requested to be accessed, corrected or removed prior to processing such requests, and we may decline to process such requests that are deemed unreasonable or inappropriate. In any case, the information access and data corrections are performed free of charge, except if doing so would require a disproportionate effort. Due to the methods that we maintain certain services, once your information is corrected or deleted; residual copies may take a period of time before they are deleted from our active systems and may remain in our backup systems.

1. BINDING EFFECT. This is a binding agreement. By using the Internet site located at https://www.salonamavi.com(the “Site” or “Service”) or any services provided in connection with the Site, you agree to abide by these Terms of Use, as they may be amended by Salon Amavi, LLC (“Salon Amavi”) from time to time. Salon Amavi will post a notice on the Site any time these Terms of Use have been changed or otherwise updated.
2. PRIVACY POLICY. Salon Amavi respects your privacy and permits you to control the treatment of your personal information. A complete statement of Salon Amavi’s current privacy policy can be found by clicking the “privacy” link at the bottom of the page. Salon Amavi’s privacy policy is expressly incorporated into this Agreement by this reference.
3. GOVERNING LAW. These Terms shall be construed in accordance with and governed by the laws of the United States and the State of Iowa, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Des Moines, Iowa in all disputes arising out of or related to the use of the site.
4. AGE. The site is intended only for users aged 18 or older. Individuals under the age of 18 are strictly prohibited from using the site and the accounts for any such person shall be terminated upon discovery.
5. USER CONTENT. You grant Salon Amavi a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting Salon Amavi, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of Salon Amavi, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You will not be compensated for any User Content. You agree that Salon Amavi may publish or otherwise disclose your name in connection with your User Content. By posting User Content on the Site or Service, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content.
6. COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS. When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content (collectively, “Content”) in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights. The burden of proving that any Content does not violate any laws or third party rights rests solely with you.
7. INAPPROPRIATE CONTENT. You shall not make the following types of Content available. You agree not to upload, download, display, perform, transmit, or otherwise distribute any Content that (a) is libelous, defamatory, obscene, pornographic, abusive, or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or foreign law or regulation; or (c) advertises or otherwise solicits funds or is a solicitation for goods or services. Salon Amavi reserves the right to terminate your receipt, transmission, or other distribution of any such material using the Service, and, if applicable, to delete any such material from its servers. Salon Amavi intends to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Use or of any applicable laws.
8. ALLEGED VIOLATIONS. Salon Amavi reserves the right to terminate your use of the Service and/or the Site. To ensure that Salon Amavi provides a high quality experience for you and for other users of the Site and the Service, you agree that Salon Amavi or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site or the Service. Salon Amavi does not intend to disclose the existence or occurrence of such an investigation unless required by law, but Salon Amavi reserves the right to terminate your account or your access to the Site immediately, with or without notice to you, and without liability to you, if Salon Amavi believes that you have violated any of the Terms of Use, furnished Salon Amavi with false or misleading information, or interfered with use of the Site or the Service by others.
9. NO WARRANTIES. SALON AMAVI HEREBY DISCLAIMS ALL WARRANTIES. SALON AMAVI IS MAKING THE SITE AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALON AMAVI EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. SALON AMAVI DOES NOT WARRANT THAT THE SITE OR THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SITE OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. FOR THE AVOIDANCE OF DOUBT, ALL CONTENT ON THE SITE OR SERVICE CONSTITUTES ADVICE ONLY AND DOES NOT GUARANTEE RESULTS.
10. LIMITED LIABILITY. SALON AMAVI’S LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SALON AMAVI BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY SALON AMAVI. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.
11. AFFILIATED SITES. Salon Amavi has no control over, and no liability for any third party websites or materials. Salon Amavi works with a number of partners and affiliates whose Internet sites may be linked with the Site. Because neither Salon Amavi nor the Site has control over the content and performance of these partner and affiliate sites, Salon Amavi makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and Salon Amavi assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. You acknowledge and agree that Salon Amavi makes no guarantees about, and assumes no responsibility for, the accuracy, currency, content, or quality of this third party content, and that, unless expressly provided otherwise, these Terms of Use shall govern your use of any and all third party content.
12. PROHIBITED USES. Salon Amavi imposes certain restrictions on your permissible use of the Site and the Service. You are prohibited from violating or attempting to violate any security features of the Site or Service, including, without limitation, (a) accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access; (b) attempting to probe, scan, or test the vulnerability of the Service, the Site, or any associated system or network, or to breach security or authentication measures without proper authorization; (c) interfering or attempting to interfere with service to any user, host, or network, including, without limitation, by means of submitting a virus to the Site or Service, overloading, “flooding,” “spamming,” “mail bombing,” or “crashing;” (d) using the Site or Service to send unsolicited e-mail, including, without limitation, promotions, or advertisements for products or services; (e) forging any TCP/IP packet header or any part of the header information in any e-mail or in any posting using the Service; or (f) attempting to modify, reverse-engineer, decompile, disassemble, or otherwise reduce or attempt to reduce to a human-perceivable form any of the source code used by Salon Amavi in providing the Site or Service. Any violation of system or network security may subject you to civil and/or criminal liability.
13. INDEMNITY. You agree to indemnify Salon Amavi for certain of your acts and omissions. You agree to indemnify, defend, and hold harmless Salon Amavi, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Site, your violation of these Terms of Use, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. Salon Amavi will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.
14. SEVERABILITY; WAIVER. If, for whatever reason, a court of competent jurisdiction finds any term or condition in these Terms of Use to be unenforceable, all other terms and conditions will remain unaffected and in full force and effect. No waiver of any breach of any provision of these Terms of Use shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.
15. NO LICENSE. Nothing contained on the Site should be understood as granting you a license to use any of the trademarks, service marks, or logos owned by Salon Amavi or by any third party.
16. UNITED STATES USE ONLY. The Site is controlled and operated by Salon Amavi from its offices in the State of Iowa. The domain of the website is registered in the United States and the Site is hosted in the United States. The intended audience for this site consists of individuals in the United States only. Salon Amavi makes no representation that any of the materials or the services to which you have been given access are available or appropriate for use in other locations. Your use of or access to the Site should not be construed as Salon Amavi’s purposefully availing itself of the benefits or privilege of doing business in any state or jurisdiction other than Iowa and the United States.
17. CANCELLATION AND REFUNDS. Due to your purchase being a consulting package in a business capacity, we do not offer refunds or cancellations. All contracts and purchases are binding.
18. AMENDMENTS. Salon Amavi reserves the right to amend these Terms. Should Salon Amavi seek to make such an amendment and we, in our sole discretion, consider the amendment to be material in nature, we shall:
(a) Clearly publish on the home page the fact an amendment is being made. You may contact us to discuss and contact information so you may discuss the proposed changes with us.
Should a court of competent jurisdiction rule this Amendment provision invalid, then this Amendment clause shall be terminated as part of this agreement with the agreement between us reverting to the previous set of terms applicable to the website. All amendments to the Terms shall be forward looking.
